Al trabajador autónomo sin empleados a cargo, que asume el servicio de limpieza de una comunidad de propietarios, no le resulta aplicable ni el artículo 44 del Estatuto de los Trabajadores ni la obligación de subrogación impuesta por el convenio colectivo. Un trabajador autónomo solo queda incluido en el ámbito de aplicación del convenio colectivo si es al propio tiempo empleador, no en caso contrario.
A self-employed worker without dependent employees, who assumes the cleaning service of a community of owners, does not have either article 44 of the Workers' Statute or the obligation of subrogation imposed by the collective agreement applicable. A self-employed worker is only included in the scope of application of the collective agreement if he or she is also an employer, not otherwise.
