El derecho a la asistencia consular de los ciudadanos de la Unión sin representación de sus autoridades diplomáticas o consulares en un tercer Estado fue consagrado en el Tratado de Maastricht, pero su desarrollo jurídico tuvo lugar posteriormente. Las decisiones intergubernamentales que inicialmente regularon su ejercicio fueron sustituidas por normas supranacionales, actualmente en vigor, que otorgan mayores garantías jurídicas a sus beneficiarios. Recientemente ha comenzado el proceso legislativo para la modificación de dicho marco normativo con vistas a mejorar el ámbito de aplicación y la exigibilidad de la tutela de este derecho por los poderes públicos competentes.
The right to consular protection of the citizens of the European Union without representation of their diplomatic or consular authorities in a third State was enshrined in the Treaty of Maastricht ,but its legal implementation took place later.The intergovernmental decisions that initially regulated its exercise were replaced by supranational law,currently in force, that grants better legal guarantees to the citizens.Recently,the reform of said regulatory framework has begun to improve the scope of implementation and the protection of this right by public authorities.
