Los sucesos del 24 de junio de 2022 en la frontera de Melilla, en la zona del Barrio Chino, han vuelto a poner de relieve la cuestión de la delimitación y demarcación de las fronteras terrestres entre España y Marruecos. Desde un punto de vista jurídico puede considerarse que todos los hechos sucedieron en territorio bajo soberanía española, y a partir de los Tratados internacionales del siglo XIX así como de las evidencias jurídicas y declaraciones políticas realizadas. Sin embargo la práctica y las declaraciones tanto desde el Ministerio como de la Fiscalía del Estado son distintas al considerar que se ha producido una prescripción adquisitiva a favor de Marruecos, vulnerando de este modo el título jurídico de soberanía española, cuales son los Tratados internacionales.
The events of 24 June 2022 at the Melilla border, in the Barrio Chino area, have once again highlighted the question of the delimitation and demarcation of land borders between Spain and Morocco. From a legal point of view, it can be considered that all the events took place in territory under Spanish sovereignty, and on the basis of the international treaties of the XIXth century as well as the legal evidence and political declarations made. However, the practice and declarations of both the Ministry and the State Prosecutor’s Office are different in that they consider that there has been an acquisitive prescription in favour of Morocco, thus violating the legal title of Spanish sovereignty, which are the international treaties.
