La diligencia de entrada y registro domiciliario es una diligencia de investigación que se practica con bastante frecuencia en la fase de Instrucción penal. Debido al carácter invasivo que conlleva para la intimidad de las personas implicadas en ella, se exigen unos requisitos especiales cuando se practica en un domicilio. Sin embargo, existen espacios cerrados que también van a estar rodeados de determinadas garantías cuando se ejecuta esta diligencia. Fundamentalmente se trata de proteger el secreto profesional que acompaña a determinadas profesiones, especialmente la de abogado. Analizaremos las garantías que ofrece nuestro ordenamiento jurídico en la práctica de esta diligencia cuando se ejecuta en despachos profesionales en general, y en despachos de abogados en particular.
