The need to harmonize the requirements of social protection with the (equally) worthy demands for the safeguarding of personal freedom, suggest rethinking the bail as an autonomous precautionary measure in the system of alternatives to detention. In this perspective, the reflections that Giovanni Conso shared over half a century ago, expressive of the need to conceptually separate the execution of the sentence from the precautionary microsystem, are still extremely timely.
La necessità di armonizzare le esigenze di tutela sociale con le (altrettanto) meritevoli istanze di salvaguardia della libertà personale, consigliano di ripensare la cauzione quale misura cautelare autonoma nel sistema delle alternative alla detenzione. In tale prospettiva, sono ancora di estrema attualità le riflessioni che Giovanni Conso condivideva oltre mezzo secolo fa, espressive della necessità di separare concettualmente l’esecuzione della pena dal microsistema cautelare.
