This article aims to analyze the importance of freedom of expression for the development of democracy, considering the criminalization of stalking in defense of the pillars that underlie the cyberdemocratic space. In this scenario, based on the hypothetical-deductive method, using exploratory, bibliographical and descriptive research, at first, the importance of the internet for human development and the network society as a space for promotion and democracy is discussed. Afterwards, analyzes will be made regarding freedom of expression and cyberstalking in the context of democracy in cyberspace. Finally, it is concluded that the violation of the fundamental human right to freedom of expression, as a means of exercising the expression of democracy, can characterize the crime of stalking.
O presente artigo tem como objetivo analisar a importância da liberdade de expressão para o desenvolvimento da democracia, considerando a criminalização do stalking em defesa aos pilares que fundamentam o espaço ciberdemocrático. Nesse cenário, com base no método hipotético-dedutivo, utilizando-se da pesquisa exploratória, bibliográfica e descritiva, em um primeiro momento discute-se a importância da internet para o desenvolvimento humano e a sociedade em rede como espaço de fomento e democracia. Após, serão feitas análises a respeito da liberdade de expressão e do cyberstalking no contexto da democracia no ciberespaço. Por fim, conclui-se que a ofensa ao direito humano fundamental à liberdade de expressão, como meio de exercício de manifestação da democracia, pode caracterizar crime de stalking.
