A partir de la constatación de lo que es, y lo que no es, la amnistía como institución, el trabajo resuelve el problema de interpretación constitucional que plantea el silencio de la norma de normas sobre ella, concluyendo que es admisible en el ordenamiento español. Pero que la amnistía que se concede por primera vez en el casi medio siglo del régimen constitucional vigente es claramente inconstitucional.
Starting from the verification of what the amnesty as an institution is, and what it is not, the work resolves the problem of constitutional interpretation posed by the silence of the norm of norms on it, concluding that it is admissible in the Spanish legal system. But the amnesty that is granted for the first time in the almost half century of the current constitutional regime, is clearly unconstitutional.
