En este texto se ofrece una exposición sobre las primeras manifestaciones del positivismo jurídico en México durante el último tercio del siglo XIX, producto de la adopción del positivismo comteano como doctrina oficial por parte de los liberales en el poder. Los abogados educados bajo la filosofía positi-va trasladaron el escepticismo metafísico del positivismo al ámbito del Derecho y lo proyectaron hacia los derechos naturales del hombre consagrados en la Constitución Mexicana de 1857. El principal jurista de ese período fue D. Emilio Rabasa, en cuya obra queda patente la crítica y escepticismo hacia la teoría del Derecho Natural
This essay contains a brief exposition of the first expressions on Legal Positivism in Mexico during the last third of the Nineteenth Century. This con-cept came about when the Mexican liberal govern-ment of 1867 adopted Augusto Comte’s positivism as the official doctrine for educational purposes. Lawyers educated under this new academic philo-sophy took skepticism and Metaphysics to the legal area. With emphasis on Natural Rights, established in the Mexican Constitution of 1857. The foremost jurist of that time was Emilio Rabasa, whose work still is a testimony of such ideology
