Este comentario está destinado a estudiar el significado y efectos constitucionales de las dos sentencias dictadas por la Sala Constitucional del Tribunal Supremo de Justicia en enero de 2013 y en marzo de 2013, que tuvieron por objeto asegurar primero, que ante la falta de comparecencia y juramentación del Presidente Chávez a la toma de posesión de su cargo el 10 de enero de 2013 para el período constitucional 2013-2019 para el cual había sido electo, continuara el gobierno anterior con el Vicepresidente como encargado del Poder Ejecuto; y segundo que con motivo del fallecimiento del Presidente Chávez sin haber tomado posesión del cargo para el cual fue electo, siguiera a cargo del Poder Ejecutivo, como Presidente Encargado el mismo Vicepresidente del gobierno anterior, hasta que ocurriera una nueva elección presidencial, asegurándole la participación a éste último como candidato, sin tener que separarse de su cargo.
These comments are devoted to study the constitutional meaning and effects of two decisions of the Constitutional Chamber of the Supreme Tribunal of Justice, issued in January 2013 and March 2013, with the following purposes: First, to assure the continuity of the previous government named by President Chavez, with a Vice President in charge of the President’s Office, due to his absence in his Inauguration and Oath on January 10, 2013, for the new constitutional term 2013-2019 for which he was elected. Second, to assure that when President Chavez died without having taken his Oath, the same Vice President could continue in charge of the Executive, as President in charge, allowing him to participate as candidate in the presidential election without having to leave his post.
