En el presente trabajo se analiza la situación de la justicia contencioso-administrativa en España, a partir de los datos que ha publicado el Consejo General del Poder Judicial. Se propone la búsqueda de fórmulas que permitan reducir la litigiosidad o, cuando este objetivo no se alcance, la regulación de remedios extrajudiciales, como el arbitraje. Algunas cuestiones claves sobre su régimen jurídico son analizadas con el ánimo de favorecer su implantación en un ordenamiento jurídico, el español, con escasa cultura arbitral.
This paper analyzes the situation of administrative justice in Spain, from the information published by Consejo General del Poder Judicial. We try to search for ways that will reduce litigiousness or, when this goal is not achieved, the regulation of extrajudicial remedies, such as arbitration. Some key questions about the legal regime of arbitration are analyzed with the aim to encourage its implementation in Spain, where there is few arbitration culture
