El presente trabajo se abordará desde una óptica jurídico-científica y, específicamente, a la luz de instrumentos internacionales, más no del derecho interno. Dos puntos importantes a considerar para las posturas a favor o en contra del aborto: 1) si el producto de la concepción es titular de derecho y, por ende debe gozar de protección; y, 2) la confrontación de esa protección con los derechos sexuales y reproductivos del ser humano. Para el autor, juega un papel preponderante el Genoma Humano y la protección del mismo en el derecho internacional, así como su conceptualización teórica como un patrimonio de la Humanidad
This essay focusses on a legal and scientific point of view, specifically, from international treaties, and does not include a domestic law intake. Two important aspects have to considered in pro and against positions: 1) if the product of conception is entitled to rights and if so, must be protected; and 2) the confrontation of that protection with sexual and reproductive rights of a human being. In the author´s opinion, the human genome and its protection by international law play an important role, as well as its theorical conception as World Heritage.
