Las bases institucionales y fundamentales aprobadas por el Congreso para regular el nuevo proceso constituyente incluyen una cláusula de bien común, también introducida en el anteproyecto aprobado por la Comisión Experta. Con base en el método histórico y com-parado y siguiendo el derecho interamericano, la cláusula del bien común debe interpretarse para sostener dos conclusiones: (i) los mandatos transformadores del Estado social deben interpretarse considerando la capacidad estatal y el principio de progresividad, y (ii) el Es-tado social debe interpretarse desde la centralidad de la dignidad humana. Esas conclusiones podrían evitar algunos excesos presentes en el nuevo constitucionalismo latinoamericano.
The fundamental and institutional bases approved by Congress to regulate the new constituent process include a common good clause introduced in the draft approved by the Expert Commission. Based on the historical and comparative method and following the Inter-American Law, the common good clause should interpret to affirm two conclusions: (i) the transformative mandates of the Social state must be interpreted considering the state capability and the progressiveness principle, and (ii) the Social state must be interpreted ba-sed on the human dignity centrality. Those conclusions could avoid some excess in the new Latin-American constitutionalism.
