Cuba
El entorno geográfico de Cuba es el Caribe, pero sus raíces se encuentran en la América Latina hispana, a partir de la historia colonizadora común que provocó que se compartiera idioma, religión, costumbres, cultura. También, un sentido de identidad devenida de las luchas de resistencia y aspiraciones emancipadoras contra el hegemón imperial. En los estudios constitucionales cubanos se ha empleado el derecho comparado como recurso para cotejar instituciones específicas, pero no en estudios histórico-constitucionales. Influye lo anterior, es decir, ¿con quién se establece la comparación? Con el Caribe no corresponde ¿Con Hispanoamérica? El presente artículo indaga en ese particular. El objetivo es develar si existen puntos comunes del derecho constitucional cubano con el de la región.
The geographical environment of Cuba is the Caribbean. But its roots are found in Hispanic Latin America from the common colonizing history; which caused language, religion, customs, culture to be shared. Also, a sense of identity arising from the struggles of resistance, and emancipatory aspirations against the imperial hegemon. In Cuban constitutional studies, comparative law has been used as a resource to compare specific institutions, but not in historical-constitutional studies. The above influences, that is: With whom is the comparison made? It doesn't correspond to the Caribbean. With Latin America? This article investigates that particular. The objective is to reveal if there are common points of Cuban constitutional law with that of the region.
