Consecuencia inherente a la determinación de la filiación entre padres e hijos es la atribución de un derecho-deber a los padres que debe ser ejercido por ambos en beneficio de los hijos e hijas menores de edad no emancipados de acuerdo con su personalidad y con respeto a sus derechos y a su integridad física y mental. No obstante, de esta función irrenunciable e indisponible, podrán los padres ser privados judicialmente tanto del ejercicio como de la titularidad de la patria potestad en caso de incumplimiento voluntario, grave y reiterado de los deberes parentales pero también en los casos de desinterés y despreocupación por el hijo/a.
