El presente ensayo explica los orígenes de la mentira judicial en América Latina y el uso para ello de los jueces, previamente cooptados tras procesos constituyentes y «destituyentes» de las judicaturas como ocurriera en Venezuela, país pionero de la cuestión; en modo tal de que aquellos, tras la falaz idea de un nuevo constitucionalismo pudiesen, si cabe esta vez el giro de Piero Calamandrei, legalizar a la ilegalidad y el hacerle decir a los textos constitucionales lo que no dicen, con un único propósito: forjar dictaduras elegidas, dictaduras del siglo XXI, apuntalándolas sobre un artificioso y emergente derecho humano a la reelección.
Así, luego éstas hacen ver que se les persigue, cuando se les exige rendir cuentas, mediante una aviesa práctica de LawFare, como modalidad guerra global y posmoderna en la que se usa a la Justicia para la venganza política. El término, forjado sobre la idea señalada, constante en los documentos del Foro de Sao Paulo desde 1990-1991, la reivindica con dicho nombre el Grupo de Puebla treinta años más tarde; si bien LawFare es el título del proyecto de protección de derechos del pueblo judío, creado en 2015 y es el mismo que usa el Blog creado en USA para debatir sobre los límites legales de las acciones de seguridad nacional a partir de 2010, sobre todo desde que asume el poder Donald Trump.
This essay explains the origins of judicial lying in Latin America and the use for it of judges, previously co-opted after constituent and “removal” processes of the judiciaries as occurred in Venezuela, a pioneer country on the issue; in such a way that those, behind the fallacious idea of a new constitutionalism could, if possible this time the turn of Piero Calamandrei, legalize illegality and make the constitutional texts say what they do not say, with a single purpose: to forge elected dictatorships, dictatorships of the 21st century, underpinning them on an artificial and emerging human right to re-election. Thus, they then make it appear that they are persecuted, when they are held accountable, through a vicious practice of LawFare, as a global and postmodern war modality in which Justice is used for political revenge. The term, forged on the aforementioned idea, constant in the documents of the Sao Paulo Forum since 1990-1991, was claimed under that name by the Puebla Group thirty years later; Although LawFare is the title of the project to protect the rights of the Jewish people, created in 2015 and it is the same one used by the Blog created in the USA to debate the legal limits of national security actions from 2010 onwards, especially since than Donald Trump assuming power.
