La presente investigación establece el problema de desigualdad existente entre las partesdel proceso penal, toda vez que si el imputado no cuenta con recursos económicos suficientes para tener una adecuada defensa, no podrá aportar pruebas suficientes para demostrar su inocencia,ni acceder a los datos de prueba que su contraparte haya ofertado, cuestión que no acontece con la víctima u ofendido, ya que al ser representado por el ministerio público cuenta con el respaldo económico del Estado, incluyendo el auxilio de los servicios periciales, los cuales se encuentran subordinados al ministerio público por disposición legal, violentandoel derecho humano consistente en el acceso a la justicia, de aquí la importancia de desvincular al Instituto de Servicios Periciales y Ciencias Forenses de la Fiscalía General de la República con la finalidad de lograr una verdadera procuración e impartición de la justicia.
