Resumen de Régimen jurídico de los comités de ética en investigación biomédica

  El manuscrito tiene por objetivo identificar y analizar el régimen jurídico de los Comités de Ética en Investigación Biomédica. Se aplicó el método histórico y la hermenéutica jurídica de cuya aplicación se arribó a los siguientes resultados: identificación y trazo genealógico de cada uno de los tipos de comités en materia biomédica; sistematización de las normas jurídicas nacionales e internacionales aplicables a los Comités de Ética en Investigación Biomédica de México; clarificación de las relaciones entre las normativas; categorización y caracterización dela estructura de dichos Comités. La originalidad consiste en la sistematización normativa pues se integran las procedentes de CONBIOETICA y COFEPRIS por lo que hace al estado mexicano, las de la UNESCO, OMS, OPS y CIOMS por lo que respecta a organismos internacionales, y las de AMM en cuanto asociación internacional de profesionales de la salud. Finalmente las limitaciones del estudio son geográficas (México) y temporales (hasta 2020).

  The manuscript aims to identify and analyze the legal status of the Ethics Committees in Biomedical Research.The historical method and legal hermeneutics were applied and the following results were obtained from their application: identification and genealogical tracing of each type of biomedical committee;systematization of the national and international legal norms applicable to the Ethics Committees in Biomedical Research of Mexico;clarification of the relations between the regulations;categorization and characterization of the structure of those Committees. The originality consists in the normative systematization since they integrate those coming from CONBIOETICA and COFEPRIS for what it does to the Mexican state, those of the UNESCO, WHO, OPS and CIOMS with regard to international organizations, and those of AMM as an international association of health professionals.Finally, the study limitations are geographical (Mexico) and temporal (until 2020).
