El artículo realiza un estudio actual de la figura jurídica del matrimonio entre ausentes contemplada en la legislación mexicana a la luz del fenómeno de la migración. En primer término, se brinda información y cifras sobre el matrimonio en México. En un segundo apartado, se precisan datos con relación a los registros de nacionales mexicanos que radican en otros países. Posteriormente, se realiza el análisis del matrimonio entre ausentes de acuerdo con sus antecedentes y su regulación al día de hoy en el sistema jurídico mexicano. Con base en la información recabada se concluye que el matrimonio entre ausentes podría llegar a caer en desuso y convertirse en una ficción jurídica. El número de mandatos otorgados para la celebración de este tipo de uniones es casi inexistente en comparación con los nacionales mexicanos que radican en otros países y que cuentan con la edad para contraer matrimonio. Una alternativa para incentivar su uso conforme al orden de la realidad jurídica actual, es mudar a un consentimiento matrimonial electrónico existente y reconocido por la legislación mexicana.
The article carries out a current study of the legal figure of marriage between absentees contemplated in Mexican legislation in light of the phenomenon of migration. First, information and figures on marriage in Mexico are provided. In a second section, data is specified in relation to the records of Mexican nationals residing in other countries. Subsequently, the analysis of the marriage between absentees is carried out according to its antecedents and its regulation today in the Mexican legal system. Based on the information collected, it is concluded that the marriage between absentees could fall into disuse and become a legal fiction. The number of mandates granted for the celebration of thistype of union is almost non-existent compared to Mexican nationals who reside in other countries and who are of marriageable age. An alternative to encourage its use in accordance with the order of the current legal reality, is to change to an existing electronic marriage consent recognized by Mexican law.
