El presente estudio versa sobre un caso de abusos sexuales a partir de las sentencias dictadas en primera y segunda instancia y en casación. Se enfoca en subrayar la importancia de la existencia de evidencia material y objetiva como elemento corroborante del testimonio de la víctima. Y analiza con detenimiento cómo los distintos tribunales intervinientes en el proceso valoran la prueba pericial médica aportada a la causa por la defensa, examinando los razonamientos que conducen a negar fiabilidad al experto.
The present study deals with a case of sexual abuse based on the sentences handed down in the first and second instance and in cassation. It focuses on highlighting the importance of the existence of material and objective evidence as a corroborating element of the victim’s testimony. And it carefully analyzes how the different courts involved in the process evaluate the medical expert evidence provided to the case by the defense, examining the reasoning that leads to denying the expert’s reliability.
