O texto tem por objetivo analisar as políticas públicas educacionais brasileiras a partir de sua conceituação teórica de modo a evidenciar quais são as principais políticas públicas do país previstas para assegurar o direito a educação infantil. As políticas públicas educacionais brasileiras estão previstas em diversos institutos legais, destacando-se as previstas na Constituição Federal de 1988, as contidas na Lei de Diretrizes e Bases da Educação – LDB e as descritas no Plano Nacional de Educação - PNE. As políticas públicas enquanto ação de governo visam dotar as condições materiais necessárias a efetivação de direitos fundamentais, como é o caso da educação infantil. A educação infantil no Brasil é responsabilidade dos Municípios que contam com suporte financeiro e técnico da União e dos Estados. As políticas publicas educacionais previstas na LDB estão em consonância com as constitucionais, elas visam assegurar o desenvolvimento integral da criança, seguindo as premissas das Declarações internacionais e a normas internas. As conclusões apontam, para a existência de forte previsão legal de diversas políticas públicas educacionais para a educação infantil, contudo, a questão não é a falta de políticas públicas, mas sim, a efetivação delas, pelo seu implemento.
The text aims to analyze the Brazilian educational public policies from its theoretical conceptualization in order to highlight what are the main public policies in the country provided to ensure the right to early childhood education. Brazilian educational public policies are provided for in several legal institutes, highlighting those provided for in the Federal Constitution of 1988, those contained in the Law of Directives and Bases for Education -LDB, and those described in the National Education Plan -PNE. Public policies as a government action aim at providing the necessary material conditions for the realization of fundamental rights, as is the case of early childhood education. Early childhood education in Brazil is the responsibility of the Municipalities that count on financial and technical support from the Union and the States. The public educational policies provided for in the LDB are in line with the constitutional ones; they aim to ensure the full development of the child, following the premises of the international declarations and the internal rules. The conclusions point to the existence of a strong legal provision of various educational public policies for early childhood education, however, the issue is not the lack of public policies, but the effectiveness of them, for their implementation.
