The topic of this extended summary is the analysis of the causes and consequences of litigious demands in the Brazilian legal system for social development. In this context, the research identified that litigious demands are often motivated by the lack of awareness and availability of alternative methodsforconflictresolution,such asmediation,whichcontributestothe overloadofthecourtsandtheslowpaceofthejudicial system.Accesstojusticegoes beyondthemerepossibilityoffilinga lawsuitwithinthelegalsystem,involvingaccess to an effective, efficient, and accessible conflict resolution system for all citizens, regardless of their financial orsocial situation.
O tema deste artigo é a análise das causas e consequências das demandas litigantes no sistema jurídico brasileiro para o desenvolvimento da sociedade. Investigou-se o seguinte problema: Quais as causas e as consequências das demandas litigantes no sistema jurídico brasileiro? Uma das hipóteses que contribui para o aumento das demandas litigantes é a falta de conscientização e disponibilidade de métodos alternativos de resolução de conflitos, como a mediação. O objetivo geral é analisar as causas e consequências das demandas litigantes no sistema jurídico brasileiro. Trata-se de uma pesquisa qualitativa teórica com duração de seis meses. Nesse contexto, a pesquisa identificou que as demandas litigantes são frequentemente motivadas pela falta de conscientização e disponibilidade de métodos alternativos de resolução de conflitos, como a mediação, o que colabora para a sobrecarga dos tribunais e a morosidade do sistema judicial.
