El desarrollo de la normativa sobre protección de datos incrementa sus interacciones con la acción colectiva desarrollada por la representación del personal. En este contexto, se analiza, de un lado, el papel que le corresponde como garante de la integridad del derecho a la protección de datos y, de otro, y sobre todo, los conflictos que aparecen en relación con el ejercicio de sus competencias. En este último plano, se analizan las limitaciones que pueden existir al acceso a datos personales por parte de las organizaciones representativas así como las restricciones a su utilización posterior.
The development of data protection regulations is increasing its interactions with the collective action developed by staff representation. In this context, we analyze, on the one hand, its role as guarantor of the integrity of the right to data protection and, on the other hand, and above all, the conflicts that arisein relation to the exercise of its powers. On the latter point, the limitations that may exist on access to personal data by representative organizations and the restrictions on their subsequent use are analyzed.
