History, Philosophy and Literature open ways for a deeper reflection on the multiple dimensions of the legal phenomenon. On the interconnection between these different types of knowledge, this paper proposes to analyze the visible tensions between the legislated law and its constituent practice, focusing on the ideological differences that the legal area encompassed during the National-Socialist regime. Based on the reading of references from the Nazi judiciary, and from the work by Helmut Ortner The Executioner, the intention was to understand the ideological setting of a legal order, on the one hand, and the possibilities of transforming it through the potential instrumentalization in the heuristic and hermeneutic scopes of the legal methodology, on the other hand. Also, this research had the purpose of exploring the traditional association between legal-positivistic ideas and the actions of the jurists who were historically linked to the National-Socialist doctrines.
A história, a filosofia e a literatura abrem caminhos a uma reflexão mais profunda sobre as múltiplas dimensões do fenómeno jurídico. Na intersecção entre os vários saberes, este ensaio propõe-se uma problematização das tensões que marcam as relações entre o direito legislado e a sua praxis constituinte, tendo por eixo central os matizes ideológicos que a esfera jurídica nacional-socialista expressamente assumiu. Partindo de uma leitura de referenciais presentes no judiciário nazi, leitura que teve o seu mote na obra de Helmut Ortner O executor, pretendeu-se lançar um olhar sobre a configuração ideológica de uma ordem jurídica, por um lado, e sobre as possibilidades de transfiguração desta através do potencial de instrumentalização das dimensões heurística e hermenêutica da metodologia jurídica, por outro. Transversalmente, a investigação procurou explorar a tradicional associação entre pressupostos juspositivistas e a actuação dos juristas historicamente comprometidos com as doutrinas nacional-socialistas.
