Es doctrina mayoritaria que el principio dispositivo, en su primera dimensión relativa al acceso a la autonomía, ha perdido su vigencia desde el momento en que todas las provincias constituyeron ya las actuales Comunidades Autónomas. Una reciente propuesta del Ayuntamiento de León pretende recurrir de nuevo a esos procedimientos de acceso a la autonomía para crear la Comunidad Autónoma de la Región Leonesa (provincias de León, Zamora y Salamanca). Compartimos la tesis del decaimiento del principio dispositivo en los casos de fusión de Comunidades Autónomas, en todas sus modalidades. Sin embargo, en los supuestos de creación de una nueva Comunidad Autónoma a partir de una provincia o provincias segregadas de una o unas Comunidades Autónomas preexistentes -que no se extinguen en el proceso-, y siempre previa reforma estatutaria que decida la segregación parcial del territorio autonómico, podría justificarse la reactivación de las vías de acceso a la autonomía que todavía hoy recoge la Constitución.
It is the majority doctrine that the dispositive principle, in its first dimension relating to access to autonomy, has lost its validity from the moment in which all the provinces already constituted the current Autonomous Communities. A recent proposal from the León City Council aims to resort again to these procedures for access to autonomy to create the Autonomous Community of the Leonesa Region (provinces of León, Zamora and Salamanca). We share the thesis of the decline of the dispositive principle in cases of merger of Autonomous Communities, in any modality. However, in the cases of creation of a new Autonomous Community from a province or provinces segregated from one or some pre-existing Autonomous Communities - which are not extinguished in the process - and always after a statutory reform that decides the partial segregation of the territory autonomous, the reactivation of the access routes to autonomy that the Constitution still includes today could be justified.
