The increase in hate speech and hate crimes based on sexual orientation and gender identity in Europe has led the Council of Europe to become increasingly concerned with the issue. In this paper, we study the case law of the European Court of Human Rights on the subject to ascertain the level of protection afforded to individuals against homophobic and transphobic hate speech and hate crimes
El aumento en Europa de los discursos y los delitos de odio basados en la orientación sexual y en la identidad de género ha llevado al Consejo de Europa a ocuparse progresivamente del tema. En este trabajo estudiamos la jurisprudencia del Tribunal Europeo de Derechos Humanos en la materia para constatar el nivel de protección que concede a los particulares frente a los discursos que incitan al odio y los delitos de odio homófobos y tránsfobos
