A propósito de la aprobación de la Ley 12/2023, de 24 de mayo, sobre el derecho a la vivienda, este estudio trata proporcionar una aproximación, desde una perspectiva competencial, sobre la creación de un estándar mínimo nacional para su acceso y disfrute, con la intención de establecer condiciones básicas y de igualdad que aseguren un trato uniforme en todo el territorio nacional. Además, se analiza hasta qué punto la mencionada Ley sobre el derecho a la vivienda ha establecido las condiciones básicas para garantizar la igualdad en el ejercicio de este derecho.
On the occasion of the approval of Law 12/2023, of 24 May, on the right to housing, this paper attempts to offer an approach, from a jurisdictional perspective, to the establishment of a national minimum standard in its access and enjoyment, with the aim of establishing those basic and equal conditions that guarantee uniform treatment throughout the State. It also reflects on the extent to which the recent Law on the right to housing, has managed to establish the basic conditions that guarantee equality in the exercise of this right.
