El colectivo de las infancias fue tradicionalmente olvidado por el ordenamiento jurídico, prevaleciendo la idea de protección y representación guiada por el principio de beneficencia, a partir de la cual el ejercicio de los derechos de niños, niñas y adolescentes así como también la toma de decisiones que habrían de producir un profundo impacto en su existencia, se encomendaba a aquéllos adultos que se estimaba que se hallaban en mejores condiciones para ejercer dicha autoridad: los padres, el juez, el médico. Y uno de los aspectos que se ha visto atravesado por este esquema de invisibilidad/representación de la infancia con miras a su presunta protección, resulta ser el de la determinación del sexo del niño/a y la atribución de género que en su consecuencia se produce. El presente trabajo procura analizar cómo ese paradigma hegemónico tradicional se ha visto impactado a partir de la mutabilidad de la percepción de la infancia y su consiguiente subjetivización, como así también en virtud de la sanción de la Ley 26.743 de Identidad de Género y del Código Civil y Comercial.
The collective of children was traditionally forgotten by the legal system, prevailing the idea of protection and representation guided by the principle of beneficence, from which the exercise of the rights of children and adolescents as well as the decision-making that would produce a profound impact on their existence, were entrusted to those adults who were considered best placed to exercise this authority: parents, judges, doctors. And one of the aspects that has been crossed by this scheme of invisibility/representation of children with the objective of their presumed protection, turns out to be the determination of the sex of the child and the attribution of gender that consequently occurs. This paper tries to analyze how this traditional hegemonic paradigm has been impacted from the mutability of the perception of childhood and its consequent subjectivization, as well as by the sanction of Law 26.743 on Gender Identity and the Civil and Commercial Code.
