El Real Decreto-Ley 6/2023, de 19 de diciembre, ha introducido los arts. 129bis y 137bis LEC, así como el art. 258bis LECrim, y apuesta (aparentemente) por la celebración de vistas telemáticas con preferencia a las vistas presenciales. De ser así, dicho planteamiento podría vulnerar derechos fundamentales y garantías esenciales del procedimiento judicial y no estaría alineado con la regulación de esta cuestión en otros países, que claramente optan por la presencialidad antes que por la vista online.
Royal Decree-Law 6/2023, of 19 December, has introduced articles 129bis and 137bis LEC, as well as article 258 bis LECrim, and is (apparently) in favour of holding telematic hearings in preference to presential hearings. If this were the case, such an approach could violate fundamental rights and essential guarantees of judicial procedure and would not be in line with the regulation of this issue in other countries, which clearly opt for presential hearings rather than online hearings.
