El mundo es cada día un lugar más convulso y conflictivo a nivel geopolítico y con los conflictos tanto diplomáticos como militares de los últimos tiempos los países pueden temer, con cierto sentido, que su suministro energético no esté garantizado si dependen de terceros países para obtenerlo. Es necesario el fomento urgente de la investigación y utilización de fuentes de energía renovables que permitan al Estado autoabastecerse y para ello uno de los mecanismos a utilizar puede ser la contratación pública estratégica. Es intención de este trabajo abrir la posibilidad a las Administraciones de añadir en la mayoría de las licitaciones un requisito de uso de energía renovable durante la realización del objeto del contrato. Para ello se estudiarán las vías legales y jurisprudenciales para ver si ello es posible y acorde a los principios de contratación pública, así como se especificará la forma en que es posible acreditar el uso de dicha energía y las vicisitudes que envuelven a la certificación, conocida como “Garantías de Origen”.
The world is a more convulsive and conflictive place at a geopolitical level and with the diplomatic and military conflicts of recent times, countries may fear, with a certain sense, that their energy supply is not guaranteed if they depend on third countries to obtain it. It is necessary to promote the research and use of renewable energy sources that allow the State to be self-sufficient, and for this, one of the mechanisms may be the use of strategic public procurement. It is the intention of this paper to open the possibility for the Administrations to add in most of the enterprises a requirement for the use of renewable energy during the fulfilment of the object of the contract. For this, the legal and jurisprudential ways will be studied to see if this is possible and in accordance with the principles of public contracting, as well as the way to accredit the use of this kind of energy and the vicissitudes that surround this certification, known as "Guarantees of Origin".
