El procedimiento de formación de las leyes constituye una garantía de la legitimidad del acto legislativo. La consulta a las demás ramas del Poder Público, a los ciudadanos y a la sociedad organizada, prevista en el artículo 211 de la Constitución, tiene por objeto asegurar que la respuesta legislativa sea adecuada, pero no implica un condicionamiento o limitación de la potestad legislativa de la Asamblea Nacional, en particular no dispone una sujeción a los designios del Ejecutivo, como lo decidió la Sala Constitucional, al pretender someter los proyectos de ley a un supuesto control previo de viabilidad, a cargo del Ejecutivo Nacional
