La servidumbre minera es esencialmente transitoria. Ella está delimitada en virtud del aprovechamiento que se efectúe del predio dominante, por lo que resulta necesario que al momento de su constitución se determine anticipadamente la vida útil de la operación minera proyectada por el concesionario minero, lo cual permitirá identificar la extensión temporal del gravamen que se busca imponer al predio sirviente, como también, cuantificar adecuadamente los perjuicios que el titular de éste último tendrá derecho a percibir a título de indemnización. En la actualidad, se generan graves efectos jurídicos adversos a los intereses del propietario del predio sirviente, toda vez que al no existir normas legales que permitan establecer el límite temporal al momento deconstituirse este tipo de servidumbres, se desnaturaliza la transitoriedad que les es característica, mutando a una inefable prolongación indeterminada de las mismas, lo que redunda, además, en la inespecificidad de los perjuicios que se deban resarcir al dueño del predio
