    El objeto controvertido afecta a la extinción de la relación laboral. Y, en concreto, se debate el derecho a la indemnización de daños y perjuicios que tendrá el penado-trabajador cuando el centro penitenciario extingue la relación laboral existente, pero dicha extinción es declarada nula. Hasta la sentencia objeto de comentario no existía unificación de doctrina en la materia, aunque sí había dictado numerosas sentencias el Tribunal Supremo sobre cuestiones relativas a la extinción de esta relación laboral especial.

    The disputed object affects the extintion of the employment relationship. And, specifically, the right to compensation for damages that the prisoner-worker will have is debated when the penitentiary center terminates the existing employment relationship, but said extintion is declared null. Until the ruling under comment there was no unification of doctrine on the matter, although the Supreme Court had issued numerous rulings on issues related to the extintion of this special employment relationship.
