The research presented here has as its goal the Climate litigation and the Urgenda Case, having as main objective to analyze the theme based on Human Rights. Firstly, in order to delimit and situate the study’s object, will be made brief considerations about climate litigation, verifying the main precedents that contributed to international jurisprudence on the subject. Based on this, it will be possible to analyze the Case Urgenda. Can Climate Litigation be considered a promising strategy in order to protec the enviroment? As a Hypothesis, we seek to demonstrate the need to analyse the theme based on human rights, havingas reference the principle of Sustainable Development. The social and legal relevance justify the choice of the topic, besides this the climate litigation is a current subject that requires reflections in front of the challenges related to global warming,climate change and the protection of human rights and environment.The methodology will be descriptive-analytical. The technical procedures used in the research for data collection will be bibliographic, doctrinal and documentary. The method used will be the hypothetical-deductive
A presente pesquisa tem como objeto a litigância climática e o caso Urgenda, tendo como principal objetivo analisar o tema à luz dos Direitos Humanos. Primeiramente, para delimitar e situar o objeto de estudo serão realizadas breves considerações sobre a litigância climática, verificando os principais precedentes que contribuíram para a evolução da jurisprudência internacional sobre o tema. A par disso, será possível analisar o caso Urgenda. A litigânciaclimática pode ser considerada uma estratégia promissora para a proteção ao meio ambiente? Como hipótese, busca-se demonstrar a necessidade da análise do tema à luz dos Direitos Humanos, tendo como referência o Princípio do Desenvolvimento Sustentável. A escolha do tema se justifica pela relevância social e jurídica, além disso a litigância Climática é um tema atual e que requer reflexões diante dos desafios com relação ao aquecimento global, mudanças climáticas e a proteção aos direitos humanos e ao meio ambiente. A metodologia será descritivo-analítica. Os procedimentos técnicos utilizados na pesquisa para coleta de dados serão bibliográfico, doutrinário e documental. O método utilizado será o hipotético-dedutivo.
