Analizamos la situación actual de la carrera administrativa ante la potestad en materia de personal de los órganos de control fiscal venezolanos a partir del estatuto de personal de la contraloría general de la república bolivariana de Venezuela. Se parte de la hipótesis según la cual, ese estatuto al instituir que los cargos de la contraloría general de república son de confianza, en consecuencia, de libre nombramiento y remoción, contraviene los principios que garantizan la estabilidad como característica fundamental del régimen de la administración pública. Esta investigación descriptiva, mediante el análisis de contenido documental de orden doctrinal, legal y jurisprudencial permite concluir que el mencionado estatuto de personal vulnera la estabilidad de cargo y elimina la categoría de funcionario de carrera en los órganos que integran el sistema nacional de control fiscal, desconfigurando el régimen de carrera administrativa. Ese acto administrativo contraría la Constitución de la República Bolivariana de Venezuela(CRBV) y la ley, no reviste conformidad con el interés público y causa agravio a todas las personas que aspiren o desempeñen un cargo de carrera en los órganos de control fiscal razón por la cual se constituye a la luz del derecho, en objeto de nulidad por ilegalidad e inconstitucionalidad.
We analyze the current situation of the administrative career before the power in matters of personnel of the Venezuelan fiscal control bodies from the personnel statute of the general comptroller of the Bolivarian Republic of Venezuela. This descriptive investigation, through the analysis of documentary content of a doctrinal, legal, and jurisprudential nature, allows us to conclude that the aforementioned personnel statute violates the stability of position and eliminates the category of career civil servant in the bodies that make up the national fiscal control system, unset the administrative career regime.
