The article is a brief introduction to Gramsci's conception of law. It is greatly original if placed in its own historical context and the reasons for this freshness lie in the significance of law in Gramsci's thought. Gramsci was not a legal scholar and was not interested in law technicalities, but he viewed law as a "superstructure" which greatly affected the "structure" and cannot be reduced to a mere ideological covering for power relations. Law proves to be relevant in Gramsci's thought also in the light of what he calls the "società regolata" (regulated society) - the long-term task of communism in Gramsci's view, where law as such will cease, but it will be transfigured into a society governed by rules.
L'articolo rappresenta una introduzione breve alla concezione gramsciana del diritto. Contestualizzata storicamente, essa è decisamente all'avanguardia e le ragioni di questa originalità stanno nell'importanza che in Gramsci ha il diritto. Gramsci non è giurista e non vuole addentrarsi nelle sue "technicalities", ma considera il diritto una "superstruttura" che condiziona molto la "struttura" e che non può essere ridotta ad un mero rivestimento ideologico dei rapporti di potere. Questa importanza, inoltre, è confermata anche dal tema della "società regolata" che può dirsi sia l'obiettivo di lungo periodo della battaglia politica gramsciana e alla cui affermazione il diritto, secondo Gramsci, offre un contributo indispensabile.
