Además del reconocimiento del territorio como sujeto de derechos y del derecho colectivo al territorio, la jurisprudencial nacional y el sistema interamericano han examinado las incidencias del conflicto armado en la vida de las comunidades étnicas respecto del alcance de las afectaciones a sus espacios sagrados y culturales. Reconociendo este acumulado jurídico se requiere revisar los factores subyacentes que inciden en las dinámicas de conflicto en el territorio y los retos y oportunidades para construir, transformar y reparar territorios desde el derecho propio y el saber ancestral.
In addition to the recognition of the territory as a subject of rights and the collective right to the territory, national jurisprudence, and the inter-American system it has examined the impact of armed conflict on the life of ethnic communities regarding the extent of the damages to their sacred and cultural sites. Recognizing this legal accumulation, it is necessary to review the underlying factors that affect the dynamics of conflict in the territory and the challenges and opportunities to build, transform and repair territories from their own right and ancestral knowledge.
