Importante cantidad de disposiciones normativas contenidas en los textos legales tienen una textura abierta que producen diferencias legítimas. Esta textura abierta es el resultado de la ambigüedad, vaguedad, lagunas, contradicciones del lenguaje jurídico o de diversas lecturas ideológicas permitidas por los propios textos. Para superar estas diferencias se oferta la teoría de la argumentación jurídica. En el presente ensayo se ejemplifica y se justifica porqué y para qué argumentamos.
