Los programas de clemencia en el marco de la Directiva 2014/104/UE. Una revisión de las cuestiones más conflictivas

    Las políticas de clemencia surgen como un instrumento de ayuda en la lucha contra las prácticas colusorias, concretamente los cárteles, los cuales limitan la competencia en el mercado perjudicando en gran medida a este y los consumidores. Estas políticas pese a sus buenos resultados han generado a su vez numerosas críticas por diferentes motivos, principalmente por la difícil conciliación de estas con las reclamaciones de daños de los perjudicados por los cárteles. La protección otorgada a los participantes en este tipo de programas dificulta en gran medida la reparación del daño sufrido por las víctimas toda vez deniega el acceso a los documentos presentados por las empresas participantes. La Directiva 2014/104/UE nace con el objetivo de solventar esta situación, pero en última instancia articula un sistema con luces y sombras creando nuevos problemas de interpretación partiendo de la «black list». Otras cuestiones conflictivas se plantean a su vez al afectar al principio de división de poderes, la regulación de las acciones «follow on» o la defensa «passing-on» entre otras.

    Policies of clemency emerge as a helpful instrument in the fight against collusive practices, specifically cartels, which limit competition in the market and greatly harm it and consumers. Despite their positive results, these policies have also generated numerous criticisms for various reasons, primarily due to the difficult reconciliation with the damage claims of those affected by the cartels. The protection granted to participants in these programs significantly hinders the reparation of the harm suffered by the victims, as it denies access to the documents submitted by the participating companies. Directive 2014/104/EU was created with the aim of solving this situation but ultimately establishes a system with both advantages and disadvantages, creating new problems of interpretation starting from the «black list» Other contentious issues arise as well, affecting the principle of separation of powers, the regulation of «follow-on» actions, or the «passing-on» defense, among others.
