En la presente investigación se realiza un análisis sobre cuál es papel del trabajo social en la adaptación del Código Civil Catalán y la normativa en discapacidad española al marco internacional sobre discapacidad. Tras la Convención de Nueva York en 2006 se establece una nueva idea con un proceso diferente en la gestión de la capacidad jurídica de las personas con discapacidad. La capacidad jurídica antenía completa o se perdía, ahora tanto el proceso como el ejercicio aspira al reconocimiento de la voluntad de los individuos. En el Código Civil Catalán se han producido reformas para adaptarlo a las nuevasexigencias sobre capacidad jurídica de los convenios internacionales por medio del Decreto Ley 19/2021, de 31 de agosto y en el caso español por medio de la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica. Todo esto ha supuesto un escenario con nuevos roles, una acción judicial diferente y una nueva visiónen discapacidad. Se pretende establecer un sistema en el que la intervención sobre las decisiones del ciudadano sea mínima.
In the present investigation, an analysis is carried out on the role of social work in the adaptation of the Catalan Civil Code and the Spanish disability regulations to the minternational framework on disability. After the New York Convention in 2006, a new idea was established with a different process in the management of the legal capacity of people with disabilities. Legal capacity before was complete or lost, now both the process and the exercise aspire to the recognition of the will of individuals. In the Catalan Civil Code, reforms have been produced to adapt it to the new requirements regarding legal capacity of international agreements through Decree Law 19/2021, of August 31, and in the Spanish case through Law 8/2021, of June 2, which reforms the civil and procedural legislation to support people with disabilities in the exercise of their legal capacity. All this has meant a scenario with new roles, a different legal action and a new vision of disability. It is intended to establish a system in which the intervention on the decisions of the citizen is minimal.
