A lei 13.709, de 15 de agosto de 2018, Lei Geral de Proteção de Dados - LGPD, teve vigência, em sua totalidade em agosto de 2021 em face dos 24 (vinte e quatro) meses de vacatio legis e do cenário pandêmico mundial do Covid-19, por ocasião de sua vigência. A recente lei, conhecida como LGPD, tem suscitado diversos questionamentos, dentre eles a responsabilidade dos agentes de tratamento de dados e do encarregado, figuras trazidas pela legislação. Assim, a presente pesquisa pretende, a princípio, trazer uma breve apresentação dos pontos principais da lei, tais como, surgimento, conceito, finalidade, as figuras do controlador, operador e do encarregado. Num segundo momento, analisar a possibilidade de responsabilização dos agentes de tratamento e do encarregado, de forma independente, nas esferas civil, penal e administrativa, a chamada responsabilidade tríplice. Para tanto, se utilizará da análise da Lei Geral Proteção de Dados e outras legislações pertinentes, bem como de bibliografias, embora escassa, ante contemporaneidade da LGPD.
Law 13,709 of August 15, 2018, General Data Protection Law -GDPL, was in effect in August 2021 in the face of the 24 (twenty-four) months of vacatio legisand the global pandemic scenario of Covid-19, at the time of its validity. The recent law, known as the GDPL, has raised several questions, among them the responsibility of the data processing agents and the person in charge, figures brought by the legislation. Thus, the present research intends, in principle, to bring a brief presentation of the main points of the law, such as, emergence, concept, purpose, the figures of the controller, operator and the person in charge. As a second step, we must examine the possibility of holding the processing agents and the person in charge independently responsible in the civil, criminal and administrative spheres, the so-called triple liability. To do so, it will use the analysis of the General Data Protection Law andother relevant legislation, as well as bibliographies, albeit scarce, before the contemporaneity of the GDPL.
