En la presente investigación se planteó como objetivo general analizar jurídicamente la conducta intimidatoria de la relación de poder estudiante- docente a nivel universitario. Se apoya en la perspectiva cuantitativa, de tipo documental-bibliográfica. Esto en vista de que a partir de la revisión documental y el estudio de la realidad social observada se logró inferir conclusiones reflexivas por parte de los investigadores, desde el análisis de tesis, artículos científicos, normas y leyes vinculadas al tema de estudio. Se concluye que, la relación de poder entre el docente y el estudiante se estableció con la finalidad de formar ciudadanos profesionales, por medio de la construcción del aprendizaje, sin embargo, en la actualidad se han presentado nuevas circunstancias que han afectado negativamente a los estudiantes, utilizando conductas de intimidación con el personal docente para obtener un resultado favorable en la aprobación del semestre, las IES deben prestar atención a casos de intimidación.
The general objective of this research was to legally analyze the intimidating behavior of the student-teacher power relationship at the university level. It is based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the observed social reality it was possible to infer reflective conclusions by the researchers, from the analysis of theses, scientific articles, norms and laws related to the topic of study. It is concluded that, the power relationship between the teacher and the student was established with the purpose of forming professional citizens, through the construction of learning, however, at present new circumstances have arisen that have negatively affected students, using bullying behaviors with the teaching staff to obtain a favorable result in the approval of the semester, HEIs should pay attention to cases of bullying.
