The article draws an up-to-date picture of the regulation of online speech in the United States and the European Union, considering the most important regulatory innovations, several significant cases, and the main positions in the public debate, not only academic. An alternative perspective to the most popular approaches to regulating the subject is offered, with a reflection on the continuing exclusively private or non-private nature of large platforms hosting user-generated content. The conclusion reflects on the intersections that occur online between freedom of expression, ‘economic speech’ and freedom of economic initiative.
L’articolo traccia un quadro aggiornato della disciplina dell’online speech negli Stati Uniti e nell’Unione europea, considerando le più importanti innovazioni normative, diversi casi giurisprudenziali significativi, e le principali posizioni nel dibattito pubblico, non solo accademico. Viene offerta una prospettiva diversa rispetto agli approcci più diffusi alla regolamentazione della materia, con una riflessione circa la perdurante natura esclusivamente privata o meno delle grandi piattaforme che ospitano user-generated content. La conclusione riflette sulle intersezioni che avvengono online tra libertà di espressione, “economic speech” e libertà di iniziativa economica.
