En la presente investigación se planteó como objetivo general analizar jurídicamente el derecho de petición y la aplicación del silencio administrativo. El planteamiento realizado por la investigadora para el desarrollo de la metodología, es a partir del enfoque cuantitativo, mediante la indagación, recolección y análisis crítico documental y referencial bibliográfico, basándose en la exploración metódica, rigurosa y profunda de diversas fuentes documentales conformadas por artículos, tesis, leyes entre otros, describiendo los hallazgos encontrados. En la investigación, se ha empleado como técnica la revisión documental. Se recurrió, además, al método inductivo-deductivo, el cual propone que para hallar una verdad se deben escudriñar los hechos y no basarse especulaciones. Se concluye que, el silencio administrativo como regla general tiene la no contestación de una petición dirigida a la administración pública en el tiempo establecido por la Ley, como lo es el Código Orgánico Administrativo en su artículo 207 que son 30 días.
The general objective of this research was to legally analyze the right to petition and the application of administrative silence. The approach taken by the researcher for the development of the methodology is based on the quantitative approach, through the inquiry, collection and critical analysis of documents and bibliographic references, based on the methodical, rigorous and deep exploration of various documentary sources consisting of articles, theses, laws, among others, describing the findings. In the research, documentary review was used as a technique. The inductive-deductive method was also used, which proposes that in order to find the truth, the facts must be scrutinized and not based on speculations. It is concluded that administrative silence as a general rule is the non-response to a petition addressed to the public administration within the time established by the Law, as it is the Administrative Organic Code in its article 207, which is 30 days.
