La STS analiza un supuesto de incumplimiento por parte de la Administración del deber de adoptar un reglamento en el plazo de seis meses para acabar de constituir una relación jurídica que define una norma con rango legal pero que "llama" al reglamento para la integración real de la relación jurídica que configura.
La STS declara que dicho incumplimiento es una inactividad objeto de reproche y de condena de hacer en el plazo que preveía la norma, contado desde la STS, y sin que la demora en la ejecución pueda trasladarse a la invalidez del acto.
The STS analyzes a case of non-compliance by the Administration with the duty to adopt a regulation within six months to finish constituting a legal relationship that defines a norm with legal rank but that "calls" the regulation for the real integration of the legal relationship that it configures.
The STS declares that said non-compliance is an inactivity object of reproach and condemnation to be done within the term provided by the norm, counted from the STS, and without the delay in the execution being transferred to the invalidity of the act.
