The regulatory framework of teleworking in Cuba is analysed with an emphasis on collective bargaining, evidencing successes and insufficiencies. It recognizes the role of trade union, a necessary actor to promote the improvement of the legal order.
In the Cuban experience it evolves, locating points of encounter and disagreement with the realities of other legal schemes and foreign collective bargaining processes. The Cuban legislator adopts measures to extend teleworking, however the legal norms issued are still perfectible. This requires additional regulatory effort in view of its special characteristics.
Here the Cuban trade union presence allows us to contribute to the organization of telework in each area or sector. A participatory approach is then required and a leading role of trade union activism too, in this way, strengthening collective bargaining in Cuba as a formula to contribute to the protection of the rights of workers in the modality.
