    La recogida y registro de datos genéticos y biométricos constituye una de las diligencias de investigación de mayor utilidad en el proceso penal. Al mismo tiempo, se trata de actuaciones invasivas que pueden afectar a los derechos fundamentales de los ciudadanos. Por otra parte, el desarrollo tecnológico ha propiciado que la relevancia de esta clase de datos se haya incrementado, así como la necesidad de su protección. Es por ello que la jurisprudencia en esta materia contenida en la STJUE de 26 de enero de 2023 resulta del mayor interés.

    The collection and registration of genetic and biometric data is one of the most useful investigative procedures in criminal proceedings. At the same time, they represent invasive actions that can affect the fundamental rights of citizens. On the other hand, technological development has served to increase the relevance of this kind of data, as well as the need to protect it. For this reason, the case law in this matter set out in the judgment of the Court of Justice of the European Union of 26 January 2023 is of the greatest interest.
