El presente trabajo contiene un estudio sobre la regulación de la prueba del Derecho extranjero en el ordenamiento jurídico español. En concreto, tiene por objeto analizar el art. 281.2 LEC, de la mano con los arts. 33 y 34 de la Ley 29/2015, de Cooperación Jurídica Internacional en materia civil, que tratan de dar respuesta a las múltiples cuestiones que se plantean en torno a esta materia que cada día tiene mayor relevancia práctica. El objeto del presente trabajo, por tanto, es abordar el estudio de este marco jurídico y las diferentes soluciones interpretativas que suscita tanto en el ámbito judicial como en el extrajudicial.
This article is a study on the regulation of proof of foreign law in the Spanish legal system. Its specific aim is to analyse article 281.2 of the Spanish Law on Civil Procedure (LEC), together with articles 33 and 34 of Law no. 29/2015, on International Legal Cooperation in civil matters, which attempt to respond to the multiple issues raised with regard to a matter that takes on greater practical relevance on a daily basis. The objective of the article is thus to address the study of this legal framework and the different interpretative solutions it raises both in the judicial and extrajudicial spheres.
