Hace 40 años se abría a la firma la Convención de las Naciones Unidas sobre el Derecho del Mar, que en su etapa final de negociaciones debió enfrentar los cambios políticos que afectaron el escenario internacional en la década de 1980. Desde entonces el derecho internacional del mar ha evolucionado, pero queda pendiente establecer un régimen de uso y protección de la biodiversidad marina en áreas más allá de la jurisdicción estatal. Las negociaciones para redactar un nuevo tratado en esa materia han avanzado lentamente y se encuentran cercanas a lograr su objetivo, pero las tensiones que afectaron la entrada en vigor de la Convención del Mar hace cuatro décadas vuelven a aparecer y complejizan el logro de los acuerdos finales necesarios.
Forty years ago the UN Convention on the Law of the Sea was set to be signed, facing -during its final negotiation stages- political changes which affected the international scenario in the 1980s. Since that time the international law of the sea has evolved, but a marine biodiversity conservation and use framework remains to be established in areas other than state jurisdiction. Negotiations to draft a new treaty in such field have moved forward slowly and are nearing their aim; however, the tensions affecting UNCLOS’s abetting into effect four decades ago are coming back into the picture and making the necessary final agreements hard to achieve.
