La Constitución define que el trabajo no atenta contra la dignidad humana porque es la base del bienestar social, un medio de autodesarrollo y un medio de desarrollo humano, sean derechos u obligaciones. Así, el ser humano, se desarrolla desde una forma de perfección personal, y por ende desde el ser humano es la base del bienestar social, reivindicado y al mismo tiempo más humano. Trabajar como actividad en esencia significa aprender tanto valores como conocimientos técnicos que ayuden al desarrollo humano, lo que contribuye a la mejor aceptación e inclusión de los individuos en la sociedad; quienes mediante esta actividad observan el bienestar y desarrollo de la comunidad, ya sea directamente o indirectamente. Conclusión- la cárcel se considera debe entenderse el paso final en el desarrollo de juicio penal que inicia con el crimen y finaliza en investigación del suceso, detención del sospechoso, detención, juicio y finalmente enjuiciamiento, y la cantidad penitenciaria existe terminante por el perfil que el modo de justicia penitenciaria se relaciona con los reos, que tiene un impacto significativo en la administración y gestión penitenciarias
