Some texts by Alfenus Varo and Titius Aristo speak of an actio negatoria granted in cases where the servitude relationship appears difficult to configure: since the formula ‘ius non esse ’ is also used by Alfenus in place of reivindicatio, it appears extremely likely are not hypotheses of edictal actions but of formulas dating back to the procedure of the agere per sponsionem.
